Driving Without Auto Insurance In Nevada

Reader’s Question:

If you let someone drive your vehicle in the state of Nevada and they don’t have car insurance and they get into an accident, who is will be responsible, the owner or the driver?

First if you have insurance on your car it would be primary no matter if the other person who drive your vehicle had insurance or not. If the driver did have their own policy then their insurance would be used as secondary or excess insurance for damages he or she caused.

Now if you let someone to use your vehicle that is uninsured, which you should not because this is illegal, and they cause an accident, then normally both the driver who caused the accident and the owner of the car can be held liable for the damages.

As the owner of the car you have vicarious liability for those who you permit to operate it. Additionally, if you know the vehicle is uninsured you should not allow it on the roadways. Even if the driver had their own insurance on their own car it would likely not cover an accident in your car as primary insurance.
